On Wednesday, as Senators were scrutinizing yet another ‘unqualified’ judge the Trump administration was trying to confirm, things did not go according to plan.
Senators were questioning the record of Lawrence VanDyke, who Republicans have nominated to serve on the United States Court of Appeals for the Ninth Circuit, and was again rated ‘unqualified’.
Here is what the American Bar Association said about Mr. VanDyke in a letter:
Mr. VanDyke’s accomplishments are offset by the assessments of interviewees that Mr. VanDyke is arrogant, lazy, an ideologue, and lacking in knowledge of the day-today practice including procedural rules. There was a theme that the nominee lacks humility, has an “entitlement” temperament, does not have an open mind, and does not always have a commitment to being candid and truthful.”
“Some interviewees raised concerns about whether Mr. VanDyke would be fair to persons who are gay, lesbian, or otherwise part of the LGBTQ community. Mr. VanDyke would not say affirmatively that he would be fair to any litigant before him, notably members of the LGBTQ community.”
It was the questioning over the last bit that brought Mr. VanDyke to tears.
The letter, described by the Washington Post as “scathing” again highlights that the Trump administration has carried on recommending and confirming judges rated “unqualified” by the ABA.
During President Obama’s two terms, not one judge was rated so badly by the ABA.
